Former lacrosse coach will appeal conviction
CULPEPER – Former Culpeper County High School lacrosse coach and funeral services operator Scott Found will appear in Culpeper County Circuit Court on April 21 to have a trial date set in his DUI case after appealing a ruling by General District Court Judge Edward Carpenter last Thursday.
On Feb. 28, Found was found guilty of DUI after smashing his 2002 Dodge Viper into the side of a building on Nov. 9. He was sentenced to one-year in jail with all but 15 days suspended. Found was also levied with $3,200 worth of fines and penalties, had his licensed suspended for one year, and was ordered to avoid possessing or consuming alcoholic beverages for 12 months.
Found entered a plea of not guilty at the onset of Thursday's hearing.
Because Found and his attorney Rex Edwards immediately filed an appeal to the Circuit Court, Thursday's ruling was dismissed.
One of the main reason's for the appeal is that Edwards believes that there was an error with the blood alcohol test which revealed Found had a blood alcohol content of 0.15 – which by law carries a minimum jail sentence of five days. Edwards claims that a swab used to clean Found's arm did not meet state requirements, and therefore contributed to Found's high reading.
During court proceedings Thursday, four witnesses took to the stand to back the prosecutors case – including officer A.C. Cooper who was the first to arrive at the scene.
Cooper testified that Found reeked of alcohol at the scene, failed a field sobriety test, and admitted to drinking six beers and downing two shots at a local bar before the accident.
Found, who was fired as CCHS lacrosse coach two weeks ago, was unavailable for comment.
